The article deals with economic contradictions of the existing legal regime of intellectual property. Using neoinstitutional methodology, it shows that economic science does not provide sufficient theoretical foundation for strict protection of the authors’ intellectual rights. One of the reasons is the absence of a sufficiently developed informational theory of value.

Analysis of the interplay of the interests of the enterprises and of the threats hindering their realization is one of the important components of economic security. The nature of interests is understood differently in its qualitative dimension by philosophical, political and economic sciences. National economic interests are defined subjectively and ambiguously, which diminishes their analytical value. It is unreasonable to apply, as do many authors, the notions of "threats", "dangers", "challenges" and "risks" all at the same time, as their interpretations are sometimes contravening. The emphasis laid on the review of "menaces" as the unfavorable component of social processes distracts one’s attention from the search of additional options for the attainment of respective interests.
